02Services and scope
These General Terms govern electronic bookings of guided Forest Wellbeing programmes for companies, groups and individuals. A client may be a business or a consumer. A consumer is a natural person acting outside their business or profession; participation in a group alone does not determine this status.
The programme is a nature-based wellbeing activity involving sensory invitations, slow movement, silence and optional reflection. It is not healthcare, diagnosis or psychotherapy. No specific health or personal outcome is guaranteed.
These Terms form part of an individual contract when the proposal refers to them and the client receives them before accepting the proposal. An individual agreement takes priority but cannot restrict mandatory consumer rights.
03Enquiry, proposal and contract
- The interactive selector and contact form are for non-binding enquiries. Completing them, receiving a recommendation or sending an enquiry does not create a booking or a payment obligation.
- The provider prepares a specific proposal stating the scope and duration, date, location, participant numbers, total price and included services, any additional costs, payment terms and cancellation or rescheduling arrangements.
- Before the contract is concluded, the client receives the proposal, these Terms and applicable consumer information by email in a retainable format, such as an attachment or the full text.
- A contract is concluded when the client expressly accepts the specific proposal by email or signs an agreement, unless the proposal specifies another lawful method. An automatic acknowledgement of an enquiry is not acceptance of a booking.
- The client checks their details before acceptance and may request corrections. Any unclear price, date or service scope is clarified before the contract is concluded.
04Price and payment
Pricing is agreed individually according to programme scope. A consumer proposal states the total price including all applicable taxes and mandatory costs known in advance. If a cost cannot be determined in advance, the calculation method is stated. Additional paid services require prior agreement.
Any deposit, payment deadline, payment method and final settlement are stated in the accepted proposal. These Terms do not themselves impose a mandatory deposit or a fixed cancellation fee. The client receives payment details securely with the relevant document or instructions.
05Cancellation and rescheduling
Cancellation terms are agreed for each specific booking. This website does not set fixed cancellation percentages or notice periods.
Before accepting the proposal, the client receives the precise cancellation and rescheduling deadlines, any fee or its calculation method, substitute-participant rules and settlement of amounts already paid. Terms must be clear and, for consumers, fair and lawful.
Send cancellations or rescheduling requests to info@terramentis.sk. Include your name or company, programme name and date, any booking reference, and whether you request cancellation or a new date. We confirm receipt and the next steps by email. Contractual cancellation timing is based on receipt of the notice unless the accepted proposal specifies a more favourable rule.
If no cancellation fee was agreed in advance, these Terms do not themselves create one. Any statutory claims of either party remain unaffected. Non-attendance is handled under the accepted proposal; these Terms do not impose an automatic 100% fee.
Rescheduling or a substitute participant may be agreed subject to suitable capacity. A voucher or replacement date is not imposed on the client. For a series, the proposal must explain cancellation of an individual session and of the unused part of the series.
A consumer’s statutory right of withdrawal described below takes priority over contractual cancellation. No contractual cancellation penalty applies to a valid statutory withdrawal.
06Consumer statutory withdrawal
Exception for a leisure programme on a fixed date. Under section 19(1)(l) of Slovak Act No. 108/2024, withdrawal without a reason does not apply to services related to leisure activities where performance is scheduled for a specific date or period. Whether this exception applies is assessed for the individual service and explained expressly before the contract is concluded. It is not automatically applied to all Forest Wellbeing services.
Where no statutory exception applies: a consumer may withdraw from a distance service contract without giving a reason within 14 days of concluding it. Any statutory extension for a failure to provide required information remains unaffected.
Send an unequivocal withdrawal notice by email to info@terramentis.sk or by post to the registered office. The template below is optional. The deadline is met if you send the notice by its final day; prior approval from the provider is not required.
If a consumer requests performance before the withdrawal period ends, the provider first obtains separate express consent and the relevant informed acknowledgement. Acceptance of these Terms does not replace that consent. Following a valid withdrawal after performance has begun, only a proportionate price for services actually supplied may be charged, and only where statutory conditions are met. The right may be lost after full performance only under the conditions in section 19(1)(a).
Payments following statutory withdrawal are refunded within 14 days of receipt of the notice using the original payment method unless the consumer agrees to another method without additional cost. Only amounts lawfully chargeable for performance may be taken into account.
This website does not conclude contracts or take payments online; bookings are agreed afterwards.
07Weather and provider cancellation
The provider assesses conditions before the session and may adapt the route or activities while preserving the agreed nature of the service. Material changes, including a move indoors, require agreement with the client. Light rain does not necessarily mean cancellation; safety and the agreed conditions determine the approach.
If the provider cancels because of unsafe weather, an inaccessible location, their own unavailability or another impediment on their side, a replacement date is offered. The client does not have to accept it. Unless otherwise agreed, the price of the unprovided service is refunded within 14 days of cancellation, without a client cancellation fee.
If a session is interrupted for safety reasons, suitable replacement performance or settlement of the unprovided part is agreed. Statutory rights, including rights concerning defective services and damages, remain unaffected.
08Participation, safety and personal data
Pace, route and breaks are adapted to participants’ needs agreed in advance. Participants should wear suitable footwear and clothing, follow safety instructions and communicate any required adjustments. Nature involves ordinary terrain, weather and environmental risks. The provider’s statutory liability for breaches of its duties is not excluded.
Participation and personal sharing are optional. A participant may decline an invitation or, by arrangement, safely end their participation. Participation of minors requires a separate arrangement with a legal representative.
Programme preparation generally requires the adjustment needed rather than unnecessary diagnoses. Sensitive information should not be included in a standard web enquiry. If health data must be processed, the conditions and separate explicit consent are handled separately. Photography and marketing consent are not conditions of participation. Detailed information about processing data from web enquiries is available in our privacy policy; these Terms do not replace it.
09Defective services and complaints
If the service does not match the agreement, the client should report the issue promptly, ideally during the programme, so that a remedy can be sought. This does not restrict statutory deadlines or later complaints. Complaints may be sent by email or post using the details in section 01. Identify the programme, date, defect and requested remedy.
A consumer promptly receives written confirmation that a service defect has been reported and the deadline for its remedy, which must not exceed 30 days from reporting. Reasons for rejecting liability are provided in writing. Remedies depend on the defect and applicable law and may include correction, an appropriate price reduction or withdrawal where statutory conditions are met.
A business client’s rights follow the accepted contract and applicable law. A different subjective experience is not by itself a defect if the programme matched the agreement; this does not restrict rights arising from missing agreed characteristics or inadequate professional care.
10Consumer disputes and final provisions
If a consumer is dissatisfied with the handling of a complaint or believes their rights have been infringed, they may request redress from the provider. If the provider rejects the request or does not reply within 30 days of its dispatch, the consumer may apply to the competent alternative dispute resolution body under Slovak Act No. 391/2015.
For these services, the competent body is generally the Slovak Trade Inspection – alternative dispute resolution, Bajkalská 21/A, 827 99 Bratislava 27; email ars@soi.sk. The right to take legal action remains unaffected.
Slovak law applies. This choice does not deprive consumers of mandatory protection under applicable law. The Slovak text is the primary text; the English translation assists understanding and does not restrict statutory rights.
Changes to these Terms do not retrospectively alter an existing contract without a lawful basis or agreement. Clients should retain the version supplied with their proposal.
